A resolution relating to the qualifications of members of the Board of Trustees of the Town of Deer Trail
Whereas, the Town of Deer Trail, (hereinafter referred to as the "Town"), in the County of Arapahoe and the State of Colorado, is the body corporate operating as a statutory town pursuant to the general statutes of the State of Colorado; and
Whereas, the Board of Trustees (hereinafter referred to as the "Board"), deems that is both preferable and appropriate and in the best interest of the Town to adopt a "Qualifications Policy".
Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail Colorado:
- In accordance with C.R.S. 31-4-301, any person seeking appointment and/or election to Board will meet the following requirements:
- 18 years of age
- Registered elector of the Town of Deer Trail
- Resident of the Town of Deer Trail for the 12 consecutive months immediately preceding appointment or election to the Board
- Such resident seeking election or appointment meeting the aforementioned qualifications will declare the same in writing prior to appointment; prior to circulating a petition; or prior to taking the Oath of Office in the instance that a write-in candidate is successful in an election.
- If the qualifications of any Board Member is challenged in writing, a hearing will be held as soon as possible to determine whether or not the Board Member in question is indeed in violation of the requirements. If the hearing determines that the Board Member in question is in violation of the requirements, such determination will be made by a two-thirds majority vote of all the members of the Board for removal of said Board Member, in accordance with C.R.S. 31-4-307. Failure to qualify constitutes a vacancy and the Board must appoint or call an election within 60 days, or an election must be called.
