Resolution Number 99-08

The board of Trustees of the Town of Deer Trail Arapahoe County, Colorado do hereby resolve to appoint the Town Mayor or in his or her absence the mayor Pro Tem to sign and file any and all relevant and necessary water well permit applications attachments and associated documentation of behalf of the Town of Deer Trial.

Whereas, the Town of Deer Trail, (hereinafter referred to as the "Town"), in the County of Arapahoe and the State of Colorado, is the body corporate operating as a statutory town pursuant to the general statutes of the State of Colorado; and 

Whereas, the Town is presently involved in the creation of a Water System Improvements Project; and

Whereas, as part of the Water System Improvements Project, the Town will seek application for certain water rights for the Town with and through the State of Colorado Division of Water Resources, Department of Natural Resources, Ground Water Commission; and

Whereas, the State of Colorado Division of Water Resources, Department of Natural Resources, Ground Water Commission requires that municipalities designate the person or persons who are authorized to sign and file such applications; and

Whereas, The Board of Trustees of the Town (hereinafter referred to as the "Board") deems that it is both preferable and appropriate to appoint the Town Mayor, or in his or her absence, the Mayor Pro Tern to execute and file such application or associated documentation on behalf of the Town, as well as any other documentation from time to time involving water permits or rights.

Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail Colorado:

Section I 

Appointment of Town Officer to execute and file application and associated documentation. 

The Mayor of the Town of Deer Trail, or in his or her absence, the Mayor Pro Tern of the Town of Deer Trail, is hereby empowered and authorized to sign, file, and otherwise execute on behalf of the Town any application or associated documentation required to be filed with the State of Colorado Division of Water Resources, Department of Natural Resources, Ground Water Commission, for the obtainment of water rights for the Town or any other purpose associated with the Town of Deer Trail Water System Improvements Project, or from time to time any other documentation associated with water permits and/or water rights.
