A resolution imposing voluntary outdoor water use restrictions within the Town of Deer Trail Colorado 

Whereas, the Town of Deer Trail is confronted with present demands for water which threaten to exceed existing water supplies; and

Whereas, the Town cannot assure a continuous and adequate supply of water to all water users within the Town without adopting voluntary restrictions on outdoor water usage; and

Whereas, Ordinance No. 190, Section 14 states that the use of water for outdoor uses may be restricted as determined by such resolution of the Board of Trustees; and

Whereas, the following voluntary restrictions on outdoor water usage are deemed reasonable and necessary to provide for the health, safety, and welfare of the citizens of the Town.

Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail Colorado as follows: 

I. Voluntary Outdoor Water Use Restrictions.

  1. Effective Date. Effective 12:01 a.m. on June 1, 1999, and until as further ordered by Resolution of the Board, the following voluntary restrictions shall apply to all outdoor usage of water provided by the Town of Deer Trail.
    • No outdoor use of water shall be permitted at addresses served by the Town of Deer Trail water system, the last two digits of which are of a numerical designation of 00-30 except on those days of the month which have a diamond designation as designated by the Town, published in the monthly newsletter and posted at the Deer Trail Town Hall.
    • No outdoor use of water shall be permitted at addresses served by the Town of Deer Trail water system, the last two digits of which are of a numerical designation of 31-60 except on those days of the month which have a square designation as designated by the Town, published in the monthly newsletter and posted at the Deer Trail Town Hall.
    • No outdoor use of water shall be permitted at addresses served by the Town of Deer Trail water system, the last two digits of which are of a numerical designation of 61-99 except on those days of the month which have a circle designation as designated by the Town, published in the monthly newsletter and posted at the Deer Trail Town Hall.
  2. The aforesaid voluntary limitations on outdoor water use shall apply to, but not be limited to, all lawn, garden, shrubbery, and tree irrigation; the washing of any motorized or non-motorized vehicles; the filling of swimming pools, other than the public swimming pool located on the premises of Deer Trail School District 26J; and any other water use outside of the structure, except for commercial car washes. Notwithstanding the above, the provision of water for the watering of domestic animals shall not be limited.
  3. Users of outdoor water shall be voluntarily restricted from using water in a wasteful manner, which shall include but not be limited to, continuously applying water to lawns to such an extent as to result in ponding or the runoff of large quantities of water on to streets, and or gutters, applying water intended for lawn irrigation onto impervious surfaces, and all other applications of water which do not result in beneficial uses.
  4. The Board of Trustees hereby declares that a water shortage threatens, and that this resolution is necessary to the immediate preservation of the public health and safety of the residences of the Town of Deer Trail.

II. Publication and passage.

  1. Pursuant to Ordinance 190, Section 14, this resolution must be published once in a newspaper published or circulated within the Town and upon publication, this resolution shall take effect.
