A resolution of the Board of Trustees for the Town of Deer Trail, Colorado referring a Tabor Sales Tax and Use Tax question to voters and setting the Ballot issue language for the April 2, 2024, Regular Election.
Whereas, the Town's next regular election will occur on April 2, 2024.
Whereas, pursuant to Art. X, Sec. 20, of the Colorado Constitution, commonly known as TABOR, imposition of a new tax must be approved by voters; and
Whereas, on February 13, 2024, the Board of Trustees adopted an ordinance seeking to establish a Town sales and use tax, subject to voter approval.
Now, therefore, be it resolved by the Board of Trustees of the Town of Deer Trail, Colorado, as follows.
Section 1.
The Board of Trustees hereby sets and refers the following ballot issue to a vote of the Town's electors at the Town's April 2, 2024, regular election:
Ballot issue No. 1
Shall the Town of Deer Trails taxes by increased by one and three quarters percent (1.75%), annually (first fiscal year increase) beginning July 1, 2024, and by whatever additional amounts are raised annually thereafter by the adoption of a sales and use tax at a rate of one and three quarter percent (I.75%), such sales tax to be imposed on the sales of tangible personal property at retail and the furnishing of taxable services, and such use tax to be imposed on the privilege of using or consuming construction and building materials in the town or for the privilege of storing or using any motor vehicle and other vehicles purchased at retail on which registration is required, and shall all revenues derived from such sales and use tax be used as follows; seventy five percent (75%) of such revenues to pay for town infrastructure for a period of 20 years, and thereafter, such funds shall go to the towns general fund, twenty five percent (25%) shall to the towns general fund and shall the town be authorized to collect and spend such revenues as a voter-approve revenue change, notwithstanding any revenue or expenditure limitation contain in Article X, Section 20, of the Colorado Constitution ?

The designated election official is hereby directed to provide notice of the TABOR issue as required by law.
