Resolution Number 21-3

A resolution of the Board of Trustees calling for a special election and approving the intergovernmental agreement for coordinated election between the Town of Deer Trail and the Clerk and Recorder for the county of Arapahoe, Colorado. 

Whereas, the Town of Deer Trail desires to call a special election to be held on November 2, 2021 to potentially submit ballot issues regarding a new sales tax to an election;

Whereas, the Town desires to coordinate the special election with Arapahoe County;

Whereas, to participate in the coordinated election, the Town and Arapahoe County Clerk and Record must enter into an intergovernmental agreement to define and clarify each party's obligations with respect to the election; and

Whereas, the Town Board of Trustees finds it is in the best interests of the Town to enter into such an intergovernmental agreement with Arapahoe County Clerk and Recorder.

Now, therefore, be it resolved by the Board of Trustees of the Town of Deer Trail, Colorado, as follows: 

Section l. 

A special election of the Town of Deer Trail shall be held on November 2, 202 l, which election shall be coordinated with Arapahoe County and governed by the Uniform Election Code. At the special election, the Town Board of Trustees may submit at least one ballot issue to the registered electors of the Town of Deer Trail. The Town Clerk is hereby designated as the Town's election official and is authorized to coordinate the election with Arapahoe County, including meeting applicable deadlines.

Section 2. 

The intergovernmental agreement titled "Intergovernmental Agreement between Arapahoe County Clerk and Recorder and the Town of Deer Trail" is approved in substantially the form attached hereto as Exhibit A, subject to final approval by the Town Attorney. 

Section 3. 

The Mayor of the Town of Deer Trail is hereby authorized to execute the intergovernmental agreement on behalf of the Town, and also to approve minor revisions to the form of the of the agreement, if necessary, so long as the essential terms and conditions are not altered.

Section 4. 

This resolution shall be in full force and effect from an after its passage and approval.

Section 5.

If any portion or provision of this resolution shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such portion or provision shall not affect any of the remaining provisions of this resolution, the intention being that the same are severable.
