A resolution to cancel the special election to fill a vacancy on the Board of Trustees on January 7, 2014
Whereas, the Board of Trustees adopted Resolution No. 13-09 ordering a special election to be held on January 7, 2014, for the electors of the Town of Deer Trail to vote to fill a vacant seat on the Board of Trustees, pursuant to C.R.S. § 31-4-303.
Whereas, pursuant to C.R.S. § 31-10-108 of the Colorado Municipal Election Code, C.R.S. § 31-10-101 et seq., no special election may be held within the ninety (90) days preceding a regular election of the Town.
Whereas, the Town's next regular election will held on April 11 20141 and therefore holding a special election to fill a vacancy on the Board of Trustees on January 7, 2014, is within the ninety (90) day period preceding the regular election.
Whereas, the Board of Trustees desires to cancel the special election set for January 7, 2014, in order to conform to the requirements for special elections in the Municipal Election Code; and
Whereas, the electors of the Town of Deer Trail will vote to fill the vacant seat on the Board of Trustees at the April 1, 2014, election.
Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail, Colorado:
Section 1.
The Board of Trustees hereby cancels the special election set for Tuesday, the 7th day of January 2014 to fill a vacancy on the Board of Trustees.
Section 2.
The officers and employees of the Town are hereby authorized and directed to take all actions necessary and appropriate to effectuate the provisions of this Resolution in accordance with Colorado law.
