Resolution Number 06-03

A resolution of the Board of Trustees of the Town of Deer Trail, Arapahoe County, Colorado, appointing Dorothy C. Stone to be the Municipal Judge for the Municipal Court for the Town of Deer Trail.

Whereas, the Town of Deer Trail, hereinafter referred to as the "Town," in the County of Arapahoe, and State of Colorado, is the body corporate operating as a Town pursuant to the general statutes of the State of Colorado; and

Whereas, the Town has previously provided for the creation of a municipal court to hear and try all alleged violations of ordinance provisions of the Town, pursuant to Colorado Revised Statutes 13-10-104; and

Whereas, C.R.S. 13-10-105 provides and requires that the Board of Trustees of the Town of Deer Trail appoint a municipal judge to preside over the Municipal Court which appointment is to be for a specific term of not less than two years; and

Whereas, the Board wishes to appoint Dorothy C. Stone, an attorney presently practicing law in the town of Elizabeth, Colorado, who also presides over other municipal courts in Eastern Colorado, and who meets the qualifications of C.R.S. 13-10-106; and

Whereas, Dorothy C. Stone consents to serve as the Town of Deer Trail Municipal Judge upon the terms and conditions agreeable to the Town and the Municipal Court Judge.

Now, therefore, be it resolved by the Board of Trustees of the Town of Deer Trail Colorado:

Section 1.

Dorothy C. Stone is hereby appointed as the Town of Deer Trail Municipal Court Judge, such appointment to be for a period of two (2) years from the date of this Resolution. Ms. Stone shall be compensated in the amount of Two Hundred Fifty Dollars ($250.00) for each Court session that she is required to attend. Court sessions shall be arranged in advance between the Town and Ms. Stone.

Section 2. 

This Resolution is to be in full force and effect from and after its passage and approval.

Section 3. 

If any portion or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or enforceability of such portion or provision shall not affect any of the remaining provisions of this Resolution, the intention being that the same are severable.
