Resolution Number 05-04

A resolution of the Board of Trustees of the Town of Deer Trail, Arapahoe County, Colorado, determining and finding that certain parcels of real property located within the Town of Deer Trail, are dangerous building due to their abandoned and dilapidated condition. 

Whereas, the Town of Deer Trail, hereinafter referred to as the "Town," in the County of Arapahoe, and State of Colorado, is the body corporate operating as a Town pursuant to the general statutes of the State of Colorado; and

Whereas, Town Ordinance No. 212 requires the Board of Trustees of the Town to take action to bate dangerous buildings, as defined in the Ordinance; and

Whereas, certain properties located within the Town, because of their long-term abandoned and dilapidated condition, appear to be dangerous buildings as defined by Ordinance No. 212.

Now, therefore be it resolved by the Board of Trustees of the Town of Deer Trail Colorado:

Section 1.

The Board determines that those real properties described and attached hereto in Exhibit A, incorporated herein by references, should receive the required notices as mandated by ordinance No. 212, which includes the opportunity to state why such properties should not be deemed to be dangerous buildings, and which Notice will require certain remedial action to be taken within the time allowed by Ordinance.

Section 2.

The Town Clerk, with assistance from the Town Attorney, shall take such action as is necessary to determine the ownership of the subject properties and to convey the required notices of abatement.

Section 3.

The required action shall be commenced upon the passage of this Resolution and the Board shall be apprised of the action taken and the response received on a regular basis.

The Board of Trustees of the Town of Deer Trail, Colorado, met in regular session in full conformity with law and the ordinances and rules of the Town, at the Town Hall, 555 Second Avenue, Deer Trail, Colorado, on Tuesday, the 2nd day of August 2005, at 7:00 P.M.

Upon roll call the following were present, constituting a quorum:
