Resolution Number 05-03

A resolution of the Board of Trustees of the Town of Deer Trail, Arapahoe County, Colorado, Approving the grant contract with the energy and mineral impact assistance program and authorizing the execution of the contract.

Whereas, the Town of Deer Trail, hereinafter referred to as the "Town," in the County of Arapahoe, and State of Colorado, is the body corporate operating as a Town pursuant to the general statutes of the State of Colorado; and

Whereas, Colorado Revised Statutes 31-15-101(c), as amended statutorily empowers the Town to enter into contracts; and

Whereas, the Board of Trustees of the Town of Deer Trail has considered all terms and conditions of the proposed Grant Contract as submitted by the Department of Local Affairs, relative to the Town of Deer Trail Drainage Study; and

Whereas, the Town wishes to enter into the Contract and believes that it is in the best interest of the citizens of the Town of Deer Trail.

Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail Colorado:

Section 1. 

The Grant Contract, E1AF #4914 with the Colorado Department of Local Affairs is hereby approved.

Section 2. 

The Mayor of the Town, together with the Town Clerk, is hereby authorized to execute the Grant Contract, EIAF #4914, between the Department of Local Affairs and the Town of Deer Trail.

Section 3. 

This Resolution is to be in full force and effect from and after its passage and approval.

Section 4. 

If any portion or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the invalidity or enforceability of such portion or provision shall not affect any of the remaining provisions of this Resolution, the intention being that the same are severable.
