Resolution Number 04-04

A resolution submitting a ballot question to a vote of registered electors as the April 6, 2004, regular election.

Whereas, Article XVIII, Section 11 of the Colorado Constitution limits terms of office that may be served by elected officials in political subdivisions of the state, including the Mayor and Board of Trustees of the Town of Deer Trail; and

Whereas, subsection (2) of Article XVIII, Section 11 provides that the voters of any such political subdivision may lengthen, shorten or eliminate the limitations on terms of office; and

Whereas, the Town's regular election is to be held on Tuesday, April 6, 2004; and

Whereas, the Board of Trustees desires to refer to the voters of the Town of Deer Trail a ballot question concerning elimination of the limitations on terms of office as provided in Article XVIII, Section 11.

Now, therefore be it resolved by the Board of Trustees of the Town of Deer Trail, Colorado:

Section 1. 

The following ballot question, certified in essentially the form set forth below, is hereby referred to the registered electors of the Town of Deer Trail and shall appear on the ballot of the Town's regular election to be held on April 6, 2004, together with any other ballot questions or issues as may also be referred by resolution of the Board of Trustees:

Shall the limitations of terms of office imposed by article XVIII, Section 11 of the Colorado Constitution be eliminated for the mayor and trustees of the Town of Deer Trail?

Section 2.

The officers and employees of the Town are hereby authorized and directed to take all actions necessary and appropriate to effectuate the provisions of this Resolution in accordance with Colorado law.
