Resolution Number 04-02

A resolution approving and designating historic sites/landmarks for preservation within the Town of Deer Trail, Colorado. 

Whereas, the Board of Trustees may provide for the designation of local historic sites/landmarks for preservation, within the Town, as a means of encouraging and preserving the community's heritage; and

Whereas, Applications for Designation of a Historic Property have been submitted for property known as the Brown Derby, Titus Drug, Farmers State Bank and associated property; and

Whereas, on March 2, 2004, the applications were reviewed, considered, and approved by the Board of Trustees of the Town of Deer Trail; and

Now therefore be it resolved by the Board of Trustees of the Town of Deer Trail; Colorado as follows: 

  1. That the Board of Trustees hereby finds:
    1. That the Application for Designation of a Historic Property requesting designation of the Brown Derby, referred to as Northwesterly 54 feet of Lot 1, Block 5 and Southeasterly 50 ft. of Lot 2, Block 5, Original Town of Deer Trail, referred to as Exhibit "A" and attached hereto and incorporated herein by reference, has been properly submitted and approved for designation as an historic site/landmark by the Deer Trail Board of Trustees.
    2. That the Application for Designation of a Historic Property requesting designation of the Titus Drug, referred to as Northwesterly 21 feet of Southeasterly 46 ft. of Southwesterly 90 ft. of Lot 1, Block 5, Original Town of Deer Trail, referred to as Exhibit "B" and attached hereto and incorporated herein by reference, has been properly submitted and approved for designation as an historic site/landmark by the Deer Trail Board of Trustees.
    3. That the Application for Designation of a Historic Property requesting designation of the Farmers State Bank, referred to as Southeasterly 25 ft. of Lot 1, Block 5, Original Town of Deer Trail, referred to as Exhibit "C" and attached hereto and incorporated herein by reference, has been properly submitted and approved for designation as an historic site/landmark by the Deer Trail Board of Trustees.
    4. That the Brown Derby, Titus Drug, and Farmers State Bank meet the standards for designation of historic sites for preservation including:
      • They have character, interest or value, as part of the historical development, heritage or culture of the community, state, or nation; and
      • It exemplifies the cultural, economic, social, or historical heritage of the
        Town.
  2. That the Board of Trustees hereby designates the Brown Derby and associated property referred to as Northwesterly 54 feet of Lot 1, Block 5 and Southeasterly 50 ft. of Lot 2, Block 5, Original Town of Deer Trail, referred to as Exhibit "A" and attached hereto and incorporated herein by reference, as a historic site/landmark within the Town of Deer Trail.
  3. That the Board of Trustees hereby designates the Titus Drug and associated property referred to as Northwesterly 21 feet of Southeasterly 46 ft. of Southwesterly 90 ft. of Lot 1, Block 5, Original Town of Deer Trail, referred to as Exhibit "B" and attached hereto and incorporated herein by reference, as a historic site/landmark within the Town of Deer Trail.
  4. That the Board of Trustees hereby designates the Farmers State Bank and associated property referred to as Southeasterly 25 ft. of Lot 1, Block 5, Original Town of Deer Trail, referred to as Exhibit "C" and attached hereto and incorporated herein by reference, as a historic site/landmark within the Town of Deer Trail.
  5. That designation of this historic site/landmark may be amended to add features or property to the site with submittal of an Application for Designation of a Historic Property.
  6. The owner of the properties referred to as the Brown Derby, Titus Drug, and Farmers State Bank shall agree that any time after a site is designated as a historic site to notify the Town Clerk of the owner's intention to alter, demolish, move or remove the site and provide plans for the work at least thirty days prior to beginning such work. This notification requirement shall run with the land and shall bind successors and assigns. The Clerk, shall, upon receipt, forward the notification and plans to the Board of Trustees for review. The Board of Trustees shall review the plans and may advise the owner on the potential effect of the plans on the historic designation.
  7. The Town Board may, by resolution, revoke or modify the designation of a site as a historic site/landmark at any time if the Board of Trustees feels that alterations compromise its integrity.
  8. A certified copy of this Resolution shall be recorded in the records of the Arapahoe County Clerk and Recorder.
