AN ORDINANCE AMENDING SECTIONS 4-lO(a) and 6-10 OF THE DEER TRAIL MUNICIPAL CODE TO MODIFY ALLOWED USES CONSIDERED FOR HOME OCCUPATIONS BY SPECIAL REVIEW USE AND ALLOWING HOME OCCUPATIONS TO BE CONDUCTED IN AN ACCESSORY STRUCTURE

WHEREAS, the Board of Trustees desires to expand the consideration of some uses allowed as home occupations and

BE IT ORDAINED BY THE BOARD OF TRUSTEES FOR THE TOWN OF DEER TRAIL. COLORADO. THAT:

 


 

Section 1.

Section 4-l0(a) of the Town of Deer Trail Municipal Code is hereby amended to


 

 

(2) The home occupation must be conducted entirely within the principal dwelling structure or within an accessory structure located on the same premises. The storage of materials and goods associated with the home occupation may be stored in an accessory building.

 

(10) Wild game processing may be conducted as a home occupation in residential zone districts subject to review as a Special Review Use as directed by Sec. 5-50 of this code.

 

Section 2.        Section 6-10 of the Deer Trail Municipal Code is hereby amended by the addition of and changes to the following language

 

Home occupation. Any occupation or activity which is clearly incidental to and conducted wholly within a dwelling unit and not or in any accessory building or space on the premises by residents of the dwelling unit.

 

Wild game processing. A facility or establishment engaged in receiving, butchering, cleaning, cutting, packaging, freezing, smoking, or otherwise preparing wild game animals, birds, or fish for consumption. Wild game processing does not include large-scale commercial meat packing plants or slaughterhouses for domesticated livestock.

 

Section 3.        Repealer. All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict.

Section 4.        Recording and Authentication. Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk. shall be published as required by law.

EXHIBIT A

EXISTING CODE LANGUAGE FOR HOME OCCUPATIONS

Sec. 4-10. Home occupations.

  1. Permitted Accessory Use in residential zone districts. Home occupations are a permitted accessory use in all residential zone districts. Any home occupation must comply with the following criteria:

    1. The home occupation shall be accessory to the use of the structure as a residence.

    2. The home occupation must be conducted entirely within the principal dwelling structure. The storage of materials and goods associated with the home occupation may be stored in an accessory building.

    3. Only the persons residing in the home shall conduct the home occupation business.

    4. There shall be no visible advertising of the home occupation on the premises.

    5. There shall be no outdoor storage of goods or materials associated with the home occupation.

    6. There shall be no excessive or offensive noise, vibration, smoke, dust, odor, heat, glare or light or dumping of materials produced by the home occupation.

    7. The receipt or delivery of merchandise, goods or supplies for use in a home occupation shall be limited to the United States Mail, commercial parcel delivery companies or private passenger vehicle, but shall exclude large truck and/or trailer-delivered goods or merchandise.

    8. The home occupation shall not change the appearance or character of the dwelling or neighborhood. No exterior structural alterations to accommodate the home occupation are permitted.

    9. Sales conducted in conjunction with the home occupation shall be primarily by telephone, direct mail or other telecommuting means. Incidental pick-up of goods is permitted.
