ORDINANCE NO. 309

AN ORDINANCE SETTING USAGE RATES FOR THE TOWN WATER AND WASTEWATER SYSTEM

BE IT ORDAINED BY THE BOARD OF TRUSTEES FOR THE TOWN OF DEER TRAIL, COLORADO, THAT:

Section I.         Effective January 1, 2025, for usage billed in December of 2024, the following wastewater rates shall be adopted:

1. Except for those entities described in paragraph B of this Section 1 below, every residential or commercial user or person or entity that is connected to the Town wastewater system, regardless of occupancy, actual use, or habitability (including vacant lots with meter pits), shall pay a monthly basic wastewater fee of twenty dollars ($20.00) per month, plus a charge for usage assessed at the following rates based on water usage:

1-4,000 gallons:

4,001- 8,000 gallons:

8,001- 12,000 gallons:

12,00 l - 16,000 gallons: 16,00 I or more gallons:

$2.50 per 1,000 gallons;

$3.75 per 1,000 gallons;

$5.50 per 1,000 gallons;

$8.75 per 1,000 gallons; and

$21 .00 per 1.000 gallons.

2. The American Legion property, the Deer Trail Fire House, and the Deer Trail Town Hall shall be assessed a monthly wastewater charge as follows:

Section 2.        Effective January 1, 2025, for usage billed in December of 2024, the following water rates shall be adopted:

1. Every residential or commercial user or person or entity that is connected to the Town water system, regardless of occupancy. actual use. or habitability (including vacant lots with meter pits), shall pay a monthly basic water fee of twenty two dollars ($22.00) per month, plus a charge for usage assessed at the following rates:

1-4.000 gallons:

4,001- 8,000 gallons:

8.001- 12,000 gallons:

12.001 - 16,000 gallons:

16.001 or more gallons:

$3.75 per 1,000 gallons;

$5.50 per 1,000 gallons;

$8.75 per 1.000 gallons:

$15.25 per 1,000 gallons; and

$26.50 per 1.000 gallons.

Section 3.        Effective January I, 2025, the following penalties and fees shall apply for late and/or nonpayment of water and wastewater fees:

1. There is hereby imposed a Fifteen Dollar ($15.00) late fee for any payment made more than five (5) days after the date payment is otherwise due and payable;

2. In addition, there is hereby imposed the following additional fees for late and/or nonpayment:

A Ten Dollar($10.00) fee for the cost associated with a letter from the Town demanding payment for a charge not paid;

A Nineteen Dollar ($ I 9.00) fee to tum water off for non-payment; and

Section 4.

A Twenty-One Dollar ($21.00) fee to tum water back on following a shut­ off for non-payment after payment has been received by the Town.

Effective January 1, 2025, the following additional penalties and fees shall

1.             A Twenty-Five Dollar ($25.00) fee nor payments not received because of insufficient funds;

11.           A Twenty-Five Dollar ($25.00) fee for a meter inspection, unless the meter is determined to be defective;

111.         A One Hundred Dollar ($100.00) tamper fee for a first offense;

1v.       A Two Hundred Fifty Dollar ($250.00) tamper fee for a second offense; and

v.         A Five Hundred Dollar ($500.00) tamper fee for a third offense.

Section 5.        Effective January I, 2025, the following bulk water rates are hereby imposed:

1. Bulk residential water shall be charged at a rate of $4.25 per One Thousand (1,000) gallons. For purposes of this Ordinance, bulk residential water shall be limited to residential properties not within the incorporated limits of the Town, but having a Town of Deer Trail mailing address; and

2. Bulk commercial/industrial water shall be charged at a rate of Seventy Dollars ($70.00) per One Thousand (1,000) gallons. For purposes of this Ordinance, bulk commercial/industrial water shall be all other bulk water usage not defined as bulk residential water.

Section 6.        The Town hereby adopts the following schedule for administration of the billing and payments of water and wastewater charges:

1. Bills for the previous month’s usage shall be sent out on the 1st day of each month:

2. Bills are thereafter due by the 15th day of each month for the previous month’s usage:

   1. A late charge shall he imposed if payment is not received h) the I own b) 11:59pm on the 5^th day after the bill is due.

3. A Notice of Payment Delinquency and Impending Disconnection of Service shall be sent out if any balance is due and owing for sixty (60) days; and

4. Disconnection shall be done by the Town in the event payment in full or payment arrangements have not been made within ten (10) days for the date of the Notice of Disconnection.
