An ordinance amending the membership on the planning commission of the Town of Deer Trail.
Be it ordained by the Board of Trustees for the Town of Deer Trail, Colorado, that:
Section 1. Section 5-10, subsection (d) of the Town of Deer Trail Zoning Ordinance is amended to read as follows:
Planning Commission.
- Affirmation: The Planning Commission of the Town is created pursuant to and under the authority of C.R.S. § 31-23-201, et seq.
- Powers and duties: The Planning Commission shall have all powers, discretion and duties established by C.R.S. § 31-23-201, et seq.
- The Town declares, pursuant to C.R.S. § 31-23-203(a), that the personnel of the Planning Commission shall be as follows:
- The mayor and one member of the Board of Trustees appointed by the mayor shall serve as ex officio members.
- Three persons who are residents of the Town shall be appointed by the Mayor to serve six (6) year terms, except that the initial terms for the three persons first appointed to the Planning Commission by the Mayor shall be staggered as follows: one resident shall be appointed to a two-year term, one resident shall be appointed to a four year term and one member shall be appointed to a six-year term; and
- The mayor is also authorized to appoint up to two alternate members of the Planning Commission, which alternate members shall also be residents of the Town and shall serve in the absence of a member of the Planning Commission.
Section 2.
If any section, subsection, or clause of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections, and clauses shall not be affected thereby.
Section 3. Repealer.
All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict.
Section 4. Recording and Authentication.
Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk, shall be published as required by law.
Section 5. Effective Date.
This Ordinance shall become effective thirty (30) days after final publication.
