An ordinance for unpaid fees and charges in the Town to be a lien.
Be it Ordained by the Board of Trustees for the Town of Deer Trail, Colorado, that:
Section I. The following shall apply concerning unpaid fees and charges:
If any owner or owners of any lot, parcel of land, or real property within the Town neglects, fails, or refuses to pay any fees or charges due to the Town, such delinquent fees or charges, including any applicable late fees imposed by the Town, there shall be a lien upon such real estate charged. The amount due shall become a first and prior lien on the property from the date the same became due and payable, and such delinquent payments shall be enforced by assessment upon the property so served and certification shall be made to the County Treasurer for collection in the same manner as though they were part of collection of taxes. Owner(s) and all persons claiming by, through or under such owner(s), shall be deemed to have notice of such lien, whether the property is occupied by an owner, tenant, or any other person.
Section 2. Repealer.
All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict, including without limitation, any maximum specific penalty contained in any acts, orders, resolutions, or ordinances for any violation thereof.
Section 3. Recording and Authentication.
Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk and shall be published as required by law.
Section 4. Effective Date.
This Ordinance shall become effective thirty (30) days after final publication.
