An ordinance setting usage rates for the Town Water and Wastewater System
Be it ordained by the Board of Trustees for the Town of Deer Trail, Colorado, that.
Section 1.
Effective January 1, 2023, the following wastewater rates shall be adopted.
- Except for those entities described in paragraph B of this Section 1 below, every residential or commercial user or person or entity that is connected to the Town wastewater system, regardless of occupancy, actual use, or habitability (including vacant lots with meter pits), shall pay a monthly basic wastewater fee of twenty-one dollars ($21.00) per month, plus a charge for usage assessed at the rate of $3.75 per One Thousand (1,000) gallons of water used. Provided, however, such charge for usage shall be calculated based on the average monthly water usage during the months of December, January, and February.
The American Legion property, the Deer Trail Fire House, and the Deer Trail Town Hall shall be assessed a monthly wastewater charge as follows:
Base Rate Usage American Legion $21.00 $22.00 Deer Trail Fire House $21.00 $22.00 Deer Trail Town Hall $21.00 $22.00 - In addition, there is hereby imposed a Ten Dollar ($10.00) late fee for any payment made more than ten (10) days after the date payment is otherwise due and payable.
Section 2. Effective January 1, 2023, the following water rates shall be adopted:
- Every residential or commercial user or person or entity that is connected to the Town water system, regardless of occupancy, actual use, or habitability (including vacant lots with meter pits), shall pay a monthly basic water fee of twenty-two dollars ($22.00) per month, plus a charge for usage assessed at the rate of $3.75 per One Thousand (1,000) gallons of water used.
- In addition, there is hereby imposed the following fees for late and/or nonpayment:
- A Ten Dollar ($10.00) late fee for any payment made more than ten (10) days after the date payment is otherwise due and payable.
- A Twenty-Six Dollar ($26.00) fee to turn water off for non-payment; and
- A Twenty-Four Dollar ($24.00) fee to tum water back on following a shut-off for non-payment after payment has been received by the Town.
Section 3. imposed:
Effective January 1, 2023, the following bulk water rates are hereby.
- Bulk residential water shall be charged at a rate of Four Dollars and twenty-five cents ($4.25) per One Thousand (1000) gallons. For purposes of this Ordinance, bulk residential water shall be limited to residential properties not within the incorporated limits of the Town, but having a Town of Deer Trail mailing address; and
- Bulk commercial/industrial water shall be charged at a rate of $\ ·-=to •0 0 ($_.00) per One Thousand (1000) gallons. For purposes of this Ordinance, bulk commercial/industrial water shall be all other bulk water usage not defined as bulk residential water.
Section 4. Hereby repealed.
All previous ordinances regarding water and wastewater usage rates are repealed.
Section 5. Repealer.
All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict, including without limitation, any maximum specific penalty contained in any acts, orders, resolutions, or ordinances for any violation thereof.
Section 6. Recording and Authentication.
Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk and shall be published as required by law.
Section 7. Effective Date.
This Ordinance shall become effective thirty (30) days after final publication.
