Ordinance Number 286

An ordinance of the Town of Deer Trail Colorado, authorizing the Mayor and the Town Clerk to execute documents on behalf of the Water Activity Enterprise. 

Whereas, the Town's Water Activity Enterprise ("the Enterprise") is governed by the Board of Trustees.

Whereas, the Town, acting by and through the Enterprise, entered into a Loan Agreement with the Colorado Water Resources and Power Development Authority on December 23, 2019.

Whereas, that Loan Agreement specifically authorized James Johnson, the former Mayor, and Candice Reed, the former Town Clerk, to execute any related documents required to close on the loan; and

Whereas, the Board desires to authorize the current Mayor and current Town Clerk to execute any and all documents related to the Loan Agreement, including any amendments and requisitions.

Be it ordained by the Board of Trustees of the Town of Deer Trail, Colorado that:

Section 1.   

The Mayor, Judd Behrens, and the Town Clerk, Ali Gerstenberger, and their respective replacements are authorized to execute any documents related to the Loan Agreement.

Section 2. Repealer.

All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict, including without limitation, any maximum specific penalty contained in any acts, orders, resolutions, or ordinances for any violation thereof.

Section 3. Recording and Authentication.

Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk and shall be published as required by law.

Section 4. Effective Date. 

This Ordinance shall become effective thirty (30) days after final publication.
