Ordinance Number 278

An ordinance increasing the maximum fine which can be imposed for the Town of Deer Trail Ordinance violations. 

Whereas, in accordance with authority provided it in C.R.S. § 13-10-113(l)(a), the Board of Trustees desires to increase the maximum fine which can be imposed upon persons convicted of violating a municipal ordinance.

Be it ordained by the Board of Trustees for the Town of Deer Trail Colorado, that. 

Section 1. Maximum fine established. 

Any person convicted of violating a municipal ordinance may be fined an amount not to exceed $2,650.00 per occurrence. In addition, such person shall pay all costs and expenses assessed by the court. Any voluntary plea of guilty or nolo contendere to the original charge or to a lesser or substituted charge, shall subject the person pleading to all fines and/or penalties applicable to the original charge. A separate and distinct offense shall be deemed committed upon each day or portion thereof that any violation of any ordinance shall occur or continue. This maximum fine shall apply to all violations for any ordinance, regardless of whether a maximum specific penalty has been previously provided for violation thereof.

Section 2. Repealer.

All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict, including without limitation, any maximum specific penalty contained in any acts, orders, resolutions, or ordinances for any violation thereof.

Section 3. Recording and Authentication.

Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk and shall be published as required by law.

Section 4. Effective Date.

This ordinance shall become effective thirty (30) days after final publication.
