Ordinance Number 275

An ordinance approving and accomplishing the annexations of contiguous unincorporated territory known as Eastwoods located in Arapahoe County. 

Whereas, the Board of Trustees desires to annex the Eastwood Property, as described in Exhibit A, which is attached hereto and incorporated by this reference; and

Whereas, the Board of Trustees of the Town of Deer Trail, Colorado, has satisfied itself concerning the eligibility for annexation of that property described on attached Exhibit A, and concerning the conformance of the proposed annexation to the applicable law and the annexation policy of the Town of Deer Trail, Colorado.

Be it ordained by the Board of Trustees of the Town of Deer Trail, Colorado, that. 

Section 1.

The annexation by and to the Town of Deer Trail, State of Colorado, of that property described in attached Exhibit A, situated, lying and being in the County of Arapahoe, State of Colorado, meets all requirements of law and, therefore, the said annexation is hereby approved and made effective.

Section 2. 

Upon the effective date of this Annexation Ordinance all lands within the area to be annexed shall become subject to the municipal laws of the State of Colorado pertaining to statutory towns, and to all ordinances, resolutions, rules and regulations of the Town of Deer Trail.

Section 3. 

Considering all of the foregoing and based on the conviction that annexation of this property to the Town of Deer Trail will serve the best interest of the Town of Deer Trail and the owner(s) of the territory to be annexed, the unincorporated territory described in Exhibit A, which is attached hereto and made a part hereof is hereby annexed to the Town of Deer Trail, Colorado.

Section 4.  

The City Clerk shall file for recording one (1) certified copy of the Annexation Ordinance and one (1) copy of the Annexation Map with the Clerk and Recorder of the County of Arapahoe, State of Colorado.

Section 5. 

The Annexation Map showing the boundaries of the newly annexed territory as above described shall be kept on file in the office of the Arapahoe County Clerk and Recorder.

Section 6. 

The Town Clerk shall file two (2) certified copies of the Annexation Ordinance and two (2) certified copies of the Annexation Map for the Real Property with the Clerk and Recorder of the County of Arapahoe, State of Colorado, for such Clerk and Recorder's filing with the Division of Local Governments of the Department of Local Affairs and the Department of Revenue.

Section 7. Repealer.

All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict.

Section 8. Recording and Authentication.

Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk, shall be published as required by law.

Section 9.

This annexation shall become effective within thirty (30) days of the publication date of this Ordinance except for the purpose of general taxation, and for such purposes it shall become effective on January 1st of the next succeeding year following passage of this Ordinance.
