Ordinance Number 274

An ordinance creating a Planning and Zoning Commission. 

Whereas, C.R.S. § 31-23-202 authorizes the Town to create a Planning Commission with the powers and duties set forth in Title 31, Article 23, Part 2;

Whereas, C.R.S. § 31-23-306 and C.R.S. § 31-23-311 requires that where a planning commission exists, it shall be appointed as the Zoning Commission which shall exercise all of the powers and rights granted to the Zoning Commission; and

Whereas, the Board of Trustees wishes to create a Planning a Zoning Commission (the 11Commission11} for the purpose of promoting the health, safety, and welfare of the Town and the public with the membership, authority and powers as set forth in this Ordinance and as may be subsequently delegated to the Commission by resolution of the Board of Trustees.

Be it Ordained by the Board of Trustees for the Town of Deer Trail, Colorado, that: 

Section 1. 

The Planning and Zoning Commission (the "Commission"} is hereby created as an advisory board for the Town of Deer Trail as set forth in C.R.S. § 31-23-202 and C.R.S. § 31-23-306.

Section 2.

Pursuant to authority in C.R.S. § 31-23-203(4), the members of the Board of Trustees are hereby appointed as the members of the Commission with all powers and duties thereof. The term of each Commission member shall be congruent with the member's term on the Board of Trustees. Removal from the Board of Trustees shall constitute removal from the Commission. Newly elected or appointed members of the Board of Trustees shall automatically be designated as Commission members. There are no alternate Commission members.

Section 3. 

Upon its first meeting, the Commission shall adopt rules for transaction of business. The Commission shall elect a chairman from among any of its members and any other officer deemed necessary. The term of the Chairman shall be for one (1) year unless removed from the Commission earlier, with recurrent eligibility for reelection.

Section 4.  Repealer.

All acts, orders, resolutions, ordinances, or parts thereof, of the Town that are inconsistent or in conflict with this Ordinance are hereby repealed to the extent only of such inconsistency or conflict.

Section 5. Recording and Authentication.

Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk, shall be published as required by law.

Section 6. Effective Date. 

This Ordinance shall become effective thirty (30} days after final publication.
