Ordinance Number 271

An Ordinance concerning leasing certain municipal real property under certain terms and conditions. 

Whereas, the Town owns certain real property, the legal description which is attached hereto as Exhibit A (the "Premises")

Whereas, Glen Reid & Kathleen Reid (the 11Lessee11) desires to lease the Premises from the Town.

Whereas, C.R.S. § 3 l-15-713(l)(c) allows the Town lease municipal real property to others provided that the Board of Trustees deems the lease to be in the best interest of the municipality.

Whereas, C.R.S. § 31-15-713(1)(c) further provides that such lease must be approved by ordinance if the lease is for a period in excess of one year; and

Whereas, the Board has determined that the lease of the Premises is in the best interests of the Town, provided that such lease is subject to the terms set forth in a lease agreement to be entered into by the Town and the Lessee.

Be it ordained by the Board of Trustees for the Town of Deer Trail, Colorado, that: 

Section 1. 

The mayor is authorized to enter into and execute with Lessees a lease agreement for the lease of the Premises in substantially the form attached hereto as Exhibit B (the "Lease Agreement"), subject to final approval by the Town Attorney. The Lease Agreement shall be for a term of ninety-nine (99) years, subject to the terms and conditions of such Lease Agreement.

Section 2. 

If any section, subsection, or clause of this Ordinance shall be deemed to be unconstitutional or otherwise invalid, the validity of the remaining sections, subsections, and clauses shall not be affected thereby.

Section 3.

Recording and Authentication. Immediately upon its passage, this Ordinance shall be recorded in the Town of Deer Trail Book of Ordinances kept for that purpose, authenticated by the signatures of the Mayor and Clerk, shall be published as required by law.

Section 4.

This Ordinance shall become effective thirty (30) days after final publication.
