Ordinance Number 208

An ordinance concerning water and sewer fees and charges.

Whereas, by Ordinance No. 190, the Board of Trustees of the Town of Deer Trail established certain rates and fees for water service within the Town; and

Whereas, by Ordinance Nos. 148 and 175, as amended by Ordinance Nos. 186 and 188, the Board of Trustees established certain rates and fees for sanitary sewer service within the Town; and

Whereas, the Board of Trustees has determined that an increase in certain rates and fees is required to ensure that present and future financial obligations with respect to the Town's water and sewer systems can be met as they come due.

Now, therefore, be it ordained by the Board of Trustees of the Town of Deer Trail, Colorado; 

Section 1. 

Sections 28 (a), (b), (c) and (d) of Ordinance No. 190 are hereby repealed and reenacted to read as follows:

 Water service charges and fees.

  • Rate Schedule:
    • All users: For each dwelling unit served: 
      Monthly minimum service charge: $10.00
      Plus, the following charge for water used: $1.60/1,000 gal.
  • Tapping Fees:
    For each 3/4-inch tap: $2,000
    For each tap 1 inch or larger:  Price negotiable 
  • A penalty of Ten Dollars ($10.00) plus a $4.00 mailing charge for each shut-off notice mailed shall be assessed on all past due bills. This penalty may be waived if a user makes prior arrangements for payments during vacation or other periods when customer is absent for a good cause.
  • One-Time Activation Fee:
    • New customers will be required to pay a one-time non-refundable activation fee, based on number of units to be served, as follows: All Units:$50.00
    • If the billing history of any user shows the above activation fee is inadequate to protect the Town in the Town's judgment, an additional fee may be required.
    • Activation fees for motels, trailer parks, apartment houses and the like will in general be based on the number of units or households served and may be considered on a case-by-case basis.

Section 2. 

Section 12 of Ordinance Numbers 161 and 165, as amended by Ordinance Number 175, is hereby repealed and reenacted to read as follows:

Section 12. Sewer Tap Fees.

  • Residential Users.
    • First dwelling unit: $2,000.00
    • Each additional dwelling unit: $2,000.00

Section 3. 

The fees and charges as set forth herein shall be effective as of March 17, 2001.

Section 4. 

If any section, paragraph, sentence, clause, or phrase of this ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Town Board hereby declares that it would have passed this ordinance and each part or parts hereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.

Section 5. 

All other ordinances or portions thereof  inconsistent or conflicting with this ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict.
