Ordinance Number 160

An ordinance amending ordinances No.148 and No. 157 relating to water and sewer charges and water mains. 

Be it ordained by the Board of Trustees of the Town of Deer Trail, Colorado, that section 9 of Ordinance 148 is hereby amended to read as follows:

Section 9. Mains may be installed only in dedicated public streets or ways or in easements in which the Town's right of occupancy and use will be at least as good as if the area were a dedicated public street or way. All mains shall remain the property of the Town. All mains shall be installed and maintained pursuant to and in conformance with the Town's standards and shall be of size and location suitable to provide adequate service to the area for which they are installed to serve.

The proprietary functions of the Town do not require extension of its facilities beyond those currently existing and any such extensions are undertaken in the exercise of discretion as a governmental function in the interest of the public health, safety and welfare. It is a policy of the Town to extend distribution mains at the written request of an applicant therefor on the following conditions:

  • Applicant shall first have entered into a main extension agreement with the Town and deposited the amount of money required by the Town.
  • The main be installed by the Town or by a contractor pre-qualified pursuant to Town's specifications therefor.
  • If an applicant requests new or increased service which in the determination of the Town is large enough to impose a demand in excess of the capacity of the existing main, the Town may replace
    the existing main with one of appropriate size and the full cost thereof shall be paid by the applicant.

Connections to water mains and lines. It shall be unlawful for any person to make any connection with any water connection with any water pipeline main which forms a part of the Water System of the Town except pursuant to and in accordance with the permit required by this ordinance. It shall be unlawful to make any connections with any privately owned water mains or pipelines which are connected with the water utility of the Town or to change, alter or renew any presently existing private main or pipeline connected with the water utility of the Town with any pipe larger than that in use as of the effective date of this ordinance except as Provided herein.

Paragraph 17. of Ordinance 148 shall be amended as follows by adding the following at the end of the paragraph:  nor shall any water user be entitled to damages or to refund on the account of any modification, interference or termination of water service, wherever the same may be occasioned.

That Section 29 a., 1. and 2. of Ordinance 148 as amended by Ordinance 157 is hereby amended to read as follows:

Rate Schedule

  • Residential User - For each dwelling unit served by a meter: 
    Monthly minimum service charge - $7,00 plus the following charges for water used: 0 - 5000 - $.50 per 1,000 gallons (1,000 gal. min.) 5000 - 10,000 gallons - $.60 per 1,000 gallons Over 10,000 gallons - $.70 per 1,000 gallons.
  • Commercial or Industrial User:
    Monthly minimum service charge - $10.00 plus the following charges for water used: 0 - 5,000 gallons - $.70 per 1,000 gallons (1,000 gal. min.) 5,000 - 10,000 gallons - $.80 per 1,000 gallons over 10,000 gallons - $.90 per 1,000 gallons.

All ordinances or parts of ordinances in conflict or inconsistent with this ordinance are hereby repealed.

This ordinance shall take effect December 1, 1982,
