Ordinance Number 158

A Bill for an Ordinance annexing certain unincorporated lands situate in a portion of section 12, Township 5 south, Range 60 west of the 6th P.m. County of Arapahoe, State of Colorado, together with abutting streets to the Town of Deer trail, Colorado. 

Whereas, the Town Council of the Town. of Deer Trail, Colorado, adopted a resolution on the day of 1982, expressing an intent to annex the hereinafter- scribed unincorporated lands to the Town of Deer Trail pursuant to Title 31, Article 12, Section 101 et seq of the Colorado Revised Statutes, 1973, as amended, and;

Whereas, William J. Gilbert and Roberta J. Gilbert are the sole owners of one hundred percent of the property to be annexed, and they have petitioned for such annexation, and 

Whereas, the Town Council has found and determined that the lands proposed to be annexed to the Town of Deer Trail were in substantial conformity with the provisions of 31-12-104 and 31-12-105 of the Colorado Revised Statutes, 1973, as amended; and

Whereas, all matters and things required by law to be done prior to the annexation of said territory to the Town of Deer Trail have been duly performed.

Now, therefore, be it ordained by the Town Council of the Town of Deer Trail, Colorado:

Section 1

That the annexation of the following-described territory situates in the County of Arapahoe, State of Colorado, to the Town of Deer Trail, be and the same is hereby ordained and approved and said territory is hereby incorporated in and made a part of the Town of Deer Trail, to wit:(See attached Exhibit "A" incorporated herein by reference as though more fully set forth.)

Section 2

That the annexation of such territory to the Town of Deer Trail, Colorado, shall be complete and effective
on the effective date of this ordinance, except for the purpose of General Property Taxes, and shall be effective as to General Property Taxes on and after the first day of January, A.D. 1983.

Section 3

That within thirty (30) days after the effective date of this ordinance, the Town Clerk be, and she is hereby authorized and directed to:

  • File one copy of the annexation map with the original of the annexation ordinance in the office of the Town Clerk of the Town of Deer Trail, Colorado.
  • File one certified copy of the annexation ordinance and one copy of the annexation map with the Secretary of State of the State of Colorado.
  • File two certified copies of the annexation ordinance with two copies of the annexation map with the Clerk and Recorder of the County of Arapahoe, State of Colorado.

Exhibit "A" To Annexation Ordinance Town of Deer Trail, Colorado

An Annexation and Subdivision Survey for that part of the Town of Deer Trail, County of Arapahoe, State of Colorado. A parcel of land located in the SE 1/4, SE 1/4 of Section 12, Township 5 South, Range 60 West of the 6th P.M., being more particularly described as follows:

Beginning at the SE corner of said Section 12, thence N 00 0 59' 00" E on an assumed bearing, a distance of 654.10' to the true point of beginning: thence N 88 039' 39" W, a distance of 659.04'; thence N 01 0 04' 00" E, a distance of 341.99'; thence S 87 054' 53" E, a distance of 658.64'; thence S 00 059' 00" E, a distance of 333.41' to the true point of beginning, containing 5.11 acres more or less.
