Ordinance Number 133

A Bill for an ordinance annexing certain unincorporated land situate in a portion of section 18, Township 5 South, Range 59 West of the 6th P.M. County of Arapahoe, State of Colorado together with abutting Streets, to the Town of Deer Trail, Colorado.

Whereas, the Town Council of the Town of Deer Trail, Colorado, adopted a resolution on May 9, 1973, expressing an intent to annex the hereinafter described unincorporated lands to the Town of Deer Trail pursuant to Article 21, Chapter 139, of the Colorado revised Statutes, 1963, as amended, and;

Whereas, Richard C. Helling and Mildred V. Belling are the sole owners of one hundred percent of the property to be annexed, and they have Petitioned for such annexation, and

Whereas, the Town Council has found and determined that the lands proposed to be annexed to the Town of Deer Trail were in substantial conformity with the provisions of 139-21-3 and 139-21-4, of the Colorado Revised Statute, 1963, as amended; and

Whereas, all matters and things required by law to be done prior to the annexation of said territory to the Town of Deer Trail have been duly preferred.

Now, therefore, be it ordained by the Town Council of the Town of Deer Trail Colorado:

Section 1

That the annexation of the following-described territory situates in the County of Arapahoe, State of Colorado, to the Town of Deer Trail, be and the same is hereby ordained and approved and said territory is hereby incorporated in and made a part of the Town of Deer Trail, to with:

An Annexation and Subdivision Survey for that part of the Town of Deer Trail, County of Arapahoe, State of Colorado. A parcel of land located in the S1/2 1NV1/4, Section 18, Township 5 South, Range 59 West of the 6th P.M., being more particularly described as follows:

Beginning at a point which bears N89 ° 57 1 457E a distance 490.6' from the W1/4 corner said Section 18, thence N89 ° 57'45"E a distance 2188.0 feet, thence N01 °29'45"E a distance 1324.3 feet, thence S89 ° 58'38"W a distance 2678.57 feet, thence S01 ° 29 1 45"W a distance 618.3 feet, thence S36 ° 10'15"E a distance 326,8 feet, thence S32 ° 16i00"E a distance 523.1 feet to the point of beginning. The above-described parcel contains 77.31 acres, more or less.

Section 2

That the annexation such territory to the Town of Deer Trail, Colorado, shall be complete and effective on the effective date of this ordinance, exert for the purpose of General Property Taxes, and shall be effective as to General Property Taxes on and after the first day of January, A. D. 1975.

Section 3

That the Petition for Annexation contained a request for subdividing or zoning as set forth on the nap concurrently with annexation, and that this ordinance annexing said territory is expressly made subject to the granting of the subdivision and zoning as requested.

Section 4

That within thirty (30) days after the effective date of this ordinance, the Town Clerk be, and she is hereby authorized and directed to:

  1. File one copy of the annexation map with the original of the annexation ordinance in the office of the Town Clerk of the Town of Deer Trail, Colorado.
  2. File one certified copy of the annexation ordinance and one copy of the annexation map with the Secretary of State of the State of Colorado.
  3. File two certified copies of the annexation ordinance with two copies of the annexation map with the Clerk and Recorder of the County of Arapahoe, State of Colorado.
