Ordinance Number 131

An ordinance for the Regulation and Enforcement of Traffic within the Town of Deer Trail, Colorado, and penalties therefor, adopting by reference the "Model Tr:1Mo Code for Colorado Municipalities" periodically as revised and published by the State Department of Highways, State of Colorado, with any subsequent revisions and amendments, and including in the Code, references to a Secondary Code officially titled "Uniform Traffic Control Devices for all Classes of Streets and Highways" as adopted by the State Department of Highways. 

Be it ordained by the Board of Trustees of the Town of Deer Trail, Colorado:

Section I

Adoption: Pursuant to Article 34 of Chapter 139, Colorado Revised Statutes 1963, there is hereby adopted by reference for the purpose of regulating and enforcing: traffic within the Town of Deer Trail, The Model Traffic Code for Colorado Municipalities as set out above with any subsequent revisions and amendments and embodying references to a secondary code of traffic control devices as described above and herein—after jointly referred to as the "Municipal Traffic Code".

Section II

Penalties for Violation: The following penalties, herewith set forth in full, shall apply to the provisions of the Municipal Traffic Code herein adopted:

  1. It is unlawful for any person to violate any of the provisions of this ordinance.
  2. Any person, upon conviction of a violation of any provision of this ordinance, shall be punished by a fine not exceeding three hundred dollars ($300.00) or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment.

Section III

Application of Ordinance: This ordinance shall apply to every street, alley, sidewalk or sidewalk area, driveway, park, and to every other public way or public parking area within the corporate limits of this municipality, the use of which this municipality has jurisdiction to regulate.

Section IV

Effect of Ordinance: If any part or parts of this ordinance are for any reason held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this ordinance. The Board of Trustees hereby declares that it would have passed this ordinance and each part or parts thereof, irrespective of the fact that any one part or parts be declared invalid or unconstitutional.

Section V

Repeal: All former traffic ordinances or parts of ordinances of the Town of Deer Trail in conflict with or inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect the penalty for an offense committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance.

Section VI

Short Title: This ordinance may be known and cited as the Municipal Traffic Ordinance.

Section VII

Enforcing: It is the duty of the Town Marshal, or such other authorized personnel and he is hereby empowered to enforce all of the provisions of this ordinance applicable to the Town of Deer Trail.

Section VIII

Effective Date: This ordinance shall take effect and be in force immediately after publication on the 12th day of July 1973.
