Call to Order

The Board of Trustees of the Town of Deer Trail met in a regular session on Tuesday October 10th, 2023, at the Town Hall, 555 Second Ave Deer Trail, Colorado. Mayor Behrens called the meeting to order at 7:00 p.m.

Roll Call

Trustees Present: John Kettling, Gerry Lamont, Byron Mounce, Robert Rhodes

Staff Present: Ali Eldringhoff Town Clerk, Debbie Cowell Town Admin

3. Approval of the Agenda

Trustee Kettling moved; Trustee Mounce seconded the motion to approve the agenda with the following changes: Add item 7C social media policy. Voting went as follows.

4. Approval of the Meeting Minutes

Trustee Mounce moved; Trustee Kettling seconded the motion to approve the regular meeting minutes for Tuesday August 8th, 2023. Voting went as follows.

6. Approval of the Bills

Trustee Kettling moved; Trustee Mounce seconded the motion to approve the bills. Voting went as follows.

9A. 2023 proposed Budget

Trustee Mounce moved; Trustee Kettling seconded the motion to approve the 2023 proposed budget. Voting went as follows.

9B. Elks- Liquor License Renewal

Trustee Mounce moved; Trustee LaMont seconded the motion to approve the Elks liquor license renewal. Voting went as follows.

9C. Resolution 23-06

Trustee Mounce moved; Trustee LaMont seconded the motion to approve resolution 23-06. A resolution of the Board of Trustees of the Town of Deer Trail consenting to the dissolution of the Bijou Creek Homeowners Association. The voting went as follows.

9D. Ordinance 301

Trustee Mounce moved; Trustee LaMont seconded the motion to approve Ordinance 301. An ordinance extending the imposition of a temporary moratorium for one (1) additional year in duration on the processing and approval of any application for a Town of Deer Trail building permit or land use entitlement that requires a new or larger-sized water tap; and directing the continuation of the study to determine the town's capacity for new water taps. Voting went as follows.

9E. Ordinance 302

Trustee Mounce moved; Trustee LaMont seconded the motion to approve Ordinance 302. An ordinance amending Ordinance Number 293, amending the procedure for unpaid fees and charges in the Town to be a lien. Voting went as follows.

Mayor Behrens moved; Trustee LaMont seconded the motion to approve the Maguire Iron proposal in the amount of $76,500. Voting went as follows.

Public Comment

Phil Steel handed out a statue for privacy notices for our website. 

Dominic was concerned about the way the Town is charging for sewer. Stating that he only puts so much water back down the sewer as most of his usage comes from watering his lawn. He would like the Town to consider billing per resident in each household. 

Chris has questions about the community building and its uses. 

Oscar discussed the HOA being dissolved and who will take over the maintenance for those areas. 

Schabrea would like to know if the Town can mark property lines, so it is clear what areas are residential and what areas the Town maintains.
