1. Call to Order
The Board of Trustees of the Town of Deer Trail met in session on Tuesday August 13, at Town Hall, 555 Second Ave Deer Trail, Colorado. Mayor Behrens called the meeting to order at 7:00 p.m.

3.  Approval of the Agenda
Mayor Behrens asked for a motion to approve the agenda with the addition of 10 f agenda Trustee Ashley Buss moved Trustee Dara Sanders seconded the motion to approve. The voting went as follows

Mayor Behrens declared the agenda approved.


4.    Approval of the Minutes
Mayor Behrens asked for a motion to approve the minutes for the months of  April and May 2025  Trustee Ashley Buss moved Trustee Brandon Rowley seconded the motion to approve.  The voting went as follows.
Yes -  Buss, Rhodes, Richardson, Rowley, Sanders, Behrens
No – 
Abstain –
Absent –  Bell
Mayor Behrens declared the minutes for April and May 2025 approved.


5.    Reports
a.    Water-Sewer Report – Delivered by Debie Cowell – Water usage report and CORE electric

6.    Approval of the payment of the bills May 2025
Mayor Behrens asked for a motion to approve the payment of the bills for the month of May. Trustee Ashley Buss moved Trustee Brandon Rowley seconded the motion to approve.  The voting went as follows.
Yes -  Buss, Rhodes, Richarson, Rowley, Sanders, Behrens
No – 
Abstain –
Absent –  Bell
Mayor Behrens declared the minutes for May 2025 approved.
 

7.    Discussion – each topic only need 1 or 2 sentences brief description -no vote is needed
a.    Lincoln Health – 1st successful reverse shoulder surgery – Hugo 5K glow walk/run
b.    Sewer Project update – Ashley and Judd – 2 part to project – still a work in progress
c.    Easement Access – Robert to rewrite
d.    Peoplyst – Dara Sanders – interviews have started

10.     New Business

a.    Mayor Behrens asked for a motion to approve planning commission recommendations for the Maverik minor subdivision plat, development agreement, public improvements associated with Maverik. Also guardrail placed along the South and West side of 7th Ave. Trustee Ashley Buss moved Trustee Brandon Rowley second the motion to approve. The voting went as follows.

Mayor Behrens declared the Maverik 10.a  approved.

b.    Mayor Behrens asked for a motion to approve the Customer Service Position – for Sandra Rivera extended 1099 though the end of the year Dec. 31, 2025 with the addition of $1.00 per hour to her current pay starting the end of current 1099. Trustee Dara Sanders moved Trustee Ashley Buss seconded the motion to approve. The voting went as follows.
Yes -  Buss, Rhodes, Richardson, Rowley, Sanders, Behrens

Mayor Behrens declared the customer service position 10. b approved.

c.    Mayor Behrens asked for a motion to approve the  enforce action of Clayton Homes due to lack of abiding to contract the construction of the subdivision. Trustee Ashley Buss moved Trustee Emily Richardson seconded the motion to approve. The voting went as follows.
Yes -  Buss, Rhodes, Richardson, Rowley, Sanders, Behrens
No –

Mayor Behrens declared the Clayton Homes subdivision 10.c approved.

d.    Mayor Behrens asked for a motion to approve the Cultural Survey for the sewer project to continuing forward. Element to facilitate the project for no more that $7000.00. Trustee Ashley Buss moved and Trustee Robert Rhodes seconded the motion to approve. The voting went as follows.

    Mayor Behrens declared the Cultural Survey 10.d  approved.

e.    Mayor Behrens asked for a motion to approve the approval of Phillip 66 liquor license renewal. Trustee Robert Rhodes moved Trustee Ashely Buss seconded the motion to approve. Voting went as follows. 
Yes -  Buss, Rhodes, Richardson, Rowley, Sanders, Behrens
       No –

   Mayor Behrens declared the Phillip 66 liquor license renewal 10. e approved.

f.    Mayor Behrens asked for a motion to approve the approval of the Elk Lodge Special Permit July 26, 2025. Poker Run. Trustee Robert Rhodes moved Trustee Dara Sanders seconded the motion to approve. The voting went as follows. 
        Yes -  Buss, Rhodes, Richardson, Rowley, Sanders, Behrens
   No –

   Mayor Behrens declared the Elks Lodge Special Permit Poker Run 10 f. approved.

11.    Public Comments
a.    Phil Steel – Back flow permit – Judd Behrens to follow up by July 8, 2025
b.    Mr. K. -  I-70bridge work – CDOT doing maintenance
              I-70 ramp on and off the Deer Trail exit needs work – CDOT
              With Maverik possible being built – sidewalk under I-70 CDOT
c.    Mary Rose – concerned about the water bill pricing – fixed income people
                Joe K. from the town is monitoring the meter for unusual usage.
